The Kingdom of Thailand (Thailand) provides protection for well-known marks in order to prevent other individuals from registering trademarks similar to or resembling well-known marks. There is no limitation on registering the same product, or registering a product having the same characteristics of a product previously registered by the same owner of a product bearing a well-known mark. However, under the system of trade mark law presently existing, there is no systematic system of registration of well-known marks. Registrars may well differentially exercise their discretion in judging whether or not a mark is well-known in an entirely subjective manner. This has resulted in well-known marks not receiving sufficient protection and a lack of clarity in relevant legal requirements.
