This research titled “A Comparison of Thai Law and Australian Commonwealth Law on Sexting” was a qualitative study. It was a documentary research. The objectives were to (1) investigate Thai laws on sexting and (2) to compare the Thai laws to the Australian Commonwealth Laws on Sexting.
The results found that in Thailand, laws dealing with sexting problems are criminal law, civil and commercial law and computer law. Regarding the Criminal Code, the relate offences are defamation and the offence of producing, obtaining, importing, trading or supplying obscene materials. Regarding the Civil and Commercial Code, the relate offence is a wrongful act against the reputation, the credit of another person, which is a civil defamation. Concerning the computer law, the main act is the Computer Crime Act B.E. 2550 (2007).
In Australia, concerning the Commonwealth law, the law is focused on criminal law, and more specifically, child pornography offence. Moreover, sexting may also be regulated by other laws that are: defamation law, privacy law, surveillance law, the law of nuisance, confidentiality law and copyright law.
