The Supreme Courtûs Criminal Division for Persons Holding Political Positions has legal issues that should be studied : (1) Criminal proceedings for persons holding political positions can be proceeded without the defendant presence under the principles and conditions of protection of the rights of the defendants, similar to the international principle of Trial in Absentia for preventing delay in the proceedings. (2) Section 192 of the Organic Act on the Prevention and Suppression of Corruption B.E. 2561 (2018) is a retrospective law that imposes a person punishable by law enacted after a crime is committed. The author finds that public interests gained from such retrospective application of the law is insufficient to undermine the value of the Rule of Law. (3) In the appealing process of criminal judgments for persons holding political positions, the appellate body has a higher judicial status than the primary body as it acts as a higher court. It is therefore not a revision of judgments by the same court. Furthermore, granting the parties the right to appeal judgments without limitation could impact the credibility of the judgments and may cause damages to those who are affected by the judgments.
