ปัจจุบันประเทศไทยจัดให้มีการพิจารณาพิพากษาคดีสำหรับคดีลักษณะพาณิชย์โดยเฉพาะในศาลยุติธรรมชั้นต้น เช่น ศาลทรัพย์สินทางปัญญาและการค้าระหว่างประเทศกลาง แผนกคดีพาณิชย์และเศรษฐกิจ ในศาลแพ่งกรุงเทพใต้ และจัดตั้งแผนกคดีพาณิชย์และเศรษฐกิจขึ้นในศาลฎีกา แต่ความพยายามดังกล่าวยังไม่เป็นการอำนวยความยุติธรรมให้แก่คู่ความที่มีข้อพิพาททางพาณิชย์อย่างแท้จริง ไม่ว่าจะเพราะการไม่ได้กำหนดลักษณะของคดีพาณิชย์ ไม่ได้กำหนดคุณสมบัติของคู่พิพาท การจัดตั้งแผนกคดีพาณิชย์และเศรษฐกิจในศาลยุติธรรมชั้นต้นไม่ครอบคลุมทั่วประเทศไทย การที่ไม่มีผู้พิพากษาหรือผู้เชี่ยวชาญในด้านการค้าพาณิชย์ร่วมเป็นองค์คณะในการพิจารณาพิพากษาคดี การบริหารจัดการคดีพาณิชย์ของศาลยุติธรรมยังรวมกับการบริหารจัดการคดีอาญาและคดีแพ่งอื่น เป็นต้น เพื่อให้บริหารจัดการคดีที่มีลักษณะพาณิชย์ของประเทศไทยมีความเหมาะสมกับการค้าพาณิชย์ในยุคปัจจุบัน การพัฒนาระบบการบริหารจัดการคดีในระยะแรกจึงควรกำหนดขอบเขตของคดีพาณิชย์ คุณสมบัติของคู่พิพาท และคุณสมบัติผู้มีอำนาจพิจารณาพิพากษาคดีพาณิชย์ให้มีความชัดเจน วางแนวทางการบริหารจัดการคดีพาณิชย์ให้สอดคล้องกับรายงานอันดับความยาก - ง่ายในการประกอบธุรกิจ (Ease of Doing Business) ของธนาคารโลก และเครื่องมือตาม“โครงสร้างสากลเพื่อความเป็นเลิศทางการศาล” (The International Framework of Court Excellence - IFCE) ระยะที่สองควรมีการระดมสมองของภาครัฐและภาคเอกชน เพื่อแบ่งแยกกฎหมายทางแพ่งออกจากกฎหมายที่มีลักษณะพาณิชย์ ระยะที่สามควรผลักดันให้ระบบการพิจารณาพิพากษาคดีพาณิชย์ของประเทศไทยให้เป็นที่ยอมรับในระดับสากล

At present, in Thailand, the commercial matters proceed at the lower court, for instance, at Central Intellectual Property and International Trade Court, the Commercial and Economic Division, The Civil Court of Southern Bangkok, the establishment of the Commercial and Economic Division in Supreme Court to provide exclusive jurisdiction, and speed up the juridical system. Notwithstanding those attempts, people under Commercial disputes. cannot get justice. To adjudicate Commercial cases expediently, correctly, and fairly in Thailand, the improvement of the case management system must be initiated. The approaches to judicial development are divided into two phases. The first phase is to distinctly limit the scope of the Commercial litigation, characteristics of parties and justices who have specific knowledge, strategize the course of commercial case management complying with Ease of Doing Business published by the World Bank and the International framework for court excellence - IFCE. The second phase is the public and private sectors to brainstorm ways to separate the Civil from the Commercial Code. The third phase is to push the judicial system to meet international standards.
