From the study of the PDPA law of Thailand and the COPPA law of the United States, both countries have carefully and rigorously enacted laws to protect the rights of minors. The requester must obtain consent to use the information from the parent or guardian. Both countries have given the meaning of "guardian" as father and mother only. In the United States, "parents" means father and mother only as well. This is inconsistent with
today's social conditions because the minor currently does not live with his father or mother. Some minors may live with their relatives, siblings, grandfathers, grandmothers. The term "guardian" should be specifically defined in the Act and extend to persons living with minors. The father or mother can make a power of attorney with the person who takes care of the minor. The person who has the authority to give consent to the applicant must also be a descendant of the minor.
