คําแถลงของบุคคลภายนอก (amicus curiae) เป็นเครื่องมือที่สําคัญประการหนึ่ง ในกฎหมายวิธีพิจารณาความของหลายประเทศในอันที่จะทําให้ได้ความคิดเห็นและมุมมอง ที่หลากหลายต่อประเด็นปัญหาที่สําคัญในคดี อย่างไรก็ตาม การที่บุคคลภายนอกเข้าไป เกี่ยวข้องกับในคดีย่อมส่งผลต่อคดีนั้นไม่มากก็น้อยจึงจําเป็นต้องให้คู่ความที่เกี่ยวข้องที่อาจ ได้รับผลกระทบมีโอกาสแสดงความคิดเห็นต่อคําแถลงของบุคคลภายนอกนั้นด้วย

Amicus curiae is an important tool in procedural laws of many countries. The proceeding enables the court to obtain valuable views and perspectives toward important issues in a case. However, the intervention by a third party person will affect the outcome of the case to some certain extent. Therefore, it is imperative to provide parties affected by the intervention an opportunity to provide their views on the matters as well.
